Terms of Service

Welcome to Thryvo. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Thryvo, Inc. ("Thryvo," "we," "us," or "our"), governing your access to and use of the Thryvo mobile application, website, and all associated services (collectively, the "Service").

By downloading, installing, registering for, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease all use of the Service.

Age Requirement. You must be at least 16 years of age to use the Service. If you are between 16 and 18 years of age, you represent that you have obtained consent from a parent or legal guardian who has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under the age of 16.

Capacity to Contract. You represent and warrant that you have the full legal capacity and authority to enter into these Terms and that doing so will not violate any other agreement to which you are a party.

Thryvo is an AI-powered personal fitness application designed to make professional-grade fitness guidance accessible to everyone. The Service includes, but is not limited to, the following features:

AI-Powered Workout Guidance

Our proprietary machine learning models generate personalized workout plans tailored to your stated goals, fitness level, available equipment, and performance history. Plans adapt dynamically over time based on your logged activity and feedback.

Real-Time Posture & Form Analysis

Using computer vision technology accessed through your device's camera, the Service analyzes your body positioning during exercises and provides real-time feedback. This feature is intended to supplement — not replace — in-person instruction by a qualified fitness professional.

AI Food & Calorie Scanner

By photographing a meal or scanning a product barcode, users can receive estimated nutritional information including approximate calorie counts, macronutrient breakdowns, and micronutrient data. All food-related estimates are approximations based on image recognition and publicly available nutritional databases.

Progress Tracking & Analytics

Thryvo stores and visualizes your workout history, body measurements, weight logs, and nutritional summaries to help you track progress toward your goals over time.

Community & Challenges

Users may participate in optional community challenges, leaderboards, and social sharing features subject to these Terms and any applicable community guidelines.

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice, and without liability to you.

Thryvo is designed to make professional-grade fitness guidance accessible to everyone. We believe that health tracking and exercise safety should not be locked behind expensive subscription paywalls.

100% Free Access. All features of the Service — including real-time AI posture detection, food photo scanning, macro analysis, goal roadmaps, and progress tracking — are fully available to all registered users at no cost. There is no premium tier, and you will never be asked to enter credit card information or pay for any aspect of the Service.

Future Sustainability. While the Service is currently offered completely free without advertisements, we reserve the right to introduce optional, non-intrusive sponsorships, premium partnerships, or custom enterprise features in the future to support development, without restricting access to core features or charging users for existing features.

Account Registration. To access most features of the Service, you must create a Thryvo account by providing accurate, complete, and current information, including a valid email address. You agree to promptly update your account information to keep it accurate and current.

Account Security. You are solely responsible for maintaining the confidentiality of your account credentials, including your password or any third-party login tokens. You agree to notify us immediately at legal@thryvo.app if you suspect any unauthorized access to or use of your account. We will not be liable for any loss resulting from unauthorized use of your account.

One Account Per Person. Each user may maintain only one active account. Accounts are personal, non-transferable, and may not be shared with or assigned to any other individual.

Health Data. Certain features of the Service require you to input personal health data, including but not limited to height, weight, age, fitness goals, and dietary preferences. By providing this information, you consent to its use by Thryvo to personalize the Service as described in our Privacy Policy.

Account Deletion. You may delete your account at any time through the in-app settings menu. Upon deletion, your personal data will be handled in accordance with our Privacy Policy and applicable data protection law. Deletion of your account will terminate your access to the Service.

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You expressly agree not to:

• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Provide false, inaccurate, or misleading health or personal information for the purpose of manipulating AI-generated recommendations.
• Use the Service for any commercial purpose without our prior written consent, including reselling access to AI-generated plans.
• Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of any portion of the Service.
• Circumvent, disable, or otherwise interfere with security-related features of the Service, including features that prevent or restrict copying or use of content.
• Upload, post, or transmit any content that is unlawful, harassing, threatening, defamatory, obscene, or otherwise objectionable.
• Introduce any virus, Trojan horse, worm, or other malicious code into the Service.
• Use automated tools, bots, or scripts to access or scrape any portion of the Service without our written authorization.
• Engage in any activity that disproportionately burdens our infrastructure or interferes with other users' access to the Service.
• Violate any applicable local, national, or international laws or regulations in connection with your use of the Service.

Violation of these Acceptable Use provisions may result in immediate suspension or termination of your account, at our sole discretion, without prior notice and without refund.

General Wellness Only. The content, workout recommendations, nutritional guidance, and AI feedback provided through the Service are intended solely for general health and wellness purposes. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Assumption of Risk. Physical exercise involves inherent risks of injury. By using the Service, you voluntarily assume all risks associated with physical activity undertaken in reliance on the Service's recommendations, including but not limited to muscle strain, joint injury, cardiovascular events, and accidents. Thryvo shall not be liable for any injury, illness, or adverse health outcome resulting from your participation in activities suggested by the Service.

Pre-Existing Conditions. If you have or suspect you have any medical condition, injury, disability, or are pregnant, you must consult a licensed physician before using any fitness feature of the Service. You agree to immediately stop any exercise that causes pain, dizziness, shortness of breath, or other concerning symptoms, and to seek emergency medical care if necessary.

Mental Health. The Service may include wellness and mindfulness features. These features are not a substitute for professional mental health treatment. If you are experiencing a mental health crisis, please contact a qualified mental health professional or emergency services immediately.

Thryvo uses artificial intelligence and machine learning models to power its core features. While we invest significantly in the accuracy and reliability of these models, you acknowledge and accept the following inherent limitations:

Posture & Form Detection

Our AI posture detection system uses your device's camera and computer vision algorithms to analyze body positioning during exercise. This analysis is provided for general guidance only and is subject to significant limitations, including but not limited to:

• Variability in detection accuracy based on camera angle, lighting conditions, clothing, background, and device hardware.
• Inability to account for individual anatomical differences, past injuries, or physical limitations not disclosed to the system.
• Potential misidentification of body landmarks or movement patterns, particularly for complex or less common exercises.

Posture feedback from Thryvo is not equivalent to assessment by a certified personal trainer, physical therapist, or sports medicine professional and should not be relied upon as such.

Food & Nutrition Scanning

Calorie counts, macronutrient values, and nutritional estimates provided by our food scanning feature are approximations only and may differ materially from the actual nutritional content of a meal or product. Accuracy may vary based on:

• Image quality, lighting, and portion size estimation challenges inherent in photograph-based recognition.
• Variability in preparation methods, ingredient quality, and portion sizes across different food service providers and home cooks.
• The completeness and accuracy of underlying nutritional databases used to generate estimates.
• Products or dishes not yet present in our database.

If you are managing a dietary condition (such as diabetes, celiac disease, or severe food allergies) that requires precise nutritional tracking, you should not rely solely on Thryvo's food scanning estimates. Consult a registered dietitian for clinical dietary guidance.

Workout Recommendations

AI-generated workout plans are based on information you provide and general fitness principles. They are not personalized clinical exercise prescriptions. Results will vary based on individual physiology, consistency, effort, and other factors outside the Service's control.

Our Content. The Service and all of its content, features, and functionality — including but not limited to text, graphics, logos, AI models, software code, workout programs, user interface design, and the compilation thereof — are owned by Thryvo, Inc. and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws. The Thryvo name, logo, and all related marks are trademarks of Thryvo, Inc.

Limited License to You. Subject to your compliance with these Terms, Thryvo grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial fitness purposes. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our express written permission.

Your Content. You retain ownership of any content you create and upload to the Service, such as progress photos, workout logs, and food diary entries ("User Content"). By submitting User Content to the Service, you grant Thryvo a worldwide, royalty-free, non-exclusive, sublicensable license to use, store, reproduce, modify (for formatting purposes), and display your User Content solely to the extent necessary to provide and improve the Service.

Feedback. If you submit ideas, suggestions, or feedback about the Service ("Feedback"), you agree that Thryvo may use such Feedback without restriction or compensation to you. You waive any moral rights you may have in such Feedback.

Third-Party Content. The Service may include content or links to third-party resources. Thryvo does not own or control third-party content and accepts no responsibility for it. Your use of third-party services is subject to those services' own terms and privacy policies.

Termination by You. You may terminate your account and stop using the Service at any time by deleting your account through the in-app settings. Termination of your account does not entitle you to a refund of any prepaid subscription fees.

Termination by Thryvo. We reserve the right, at our sole discretion, to suspend or permanently terminate your account and access to the Service, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or in any way acted to harm other users or the Service. We will endeavor to provide reasonable notice where practicable, except in cases of serious or repeated violation.

Effect of Termination. Upon termination of your account for any reason:

• Your license to use the Service immediately terminates.
• You must cease all use of the Service and uninstall the application.
• Thryvo may, but is not required to, delete your User Content and account data, subject to our Privacy Policy and legal data retention obligations.
• Any outstanding payment obligations you have incurred remain due.

Survival. The following sections survive termination of these Terms: Intellectual Property, Health Disclaimer, Limitation of Liability, and Governing Law.

Disclaimer of Warranties. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE ACCESS. THRYVO DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THRYVO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF — OR INABILITY TO USE — THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Cap on Liability. IN NO EVENT SHALL THRYVO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING UNDER OR IN CONNECTION WITH THESE TERMS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO THRYVO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Essential Basis. The limitations set forth in this section reflect a fair allocation of risk between you and Thryvo, and are an essential basis of the bargain between the parties. Thryvo would not provide the Service without these limitations.

Jurisdictional Exceptions. Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities. To the extent that such laws apply to you, some of the above limitations may not apply. In such cases, liability is limited to the fullest extent permitted by applicable law.

We reserve the right to modify these Terms at any time to reflect changes to our Service, business practices, legal requirements, or for any other reason at our discretion. We will provide notice of material changes as follows:

• In-App Notification: We will display a prominent notice within the Thryvo application informing you that the Terms have been updated.
• Email Notification: We will send an email to the address associated with your account at least 14 days before material changes take effect, where practicable.
• "Effective Date" and "Last Updated" fields at the top of this page will be updated to reflect the date of the revision.

Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of those revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the effective date of the changes and may delete your account in accordance with Section 4.

We encourage you to review these Terms periodically. The most current version will always be available within the app and on our website.

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Informal Resolution. Before initiating any formal legal proceeding, you agree to first contact us at legal@thryvo.app to attempt to resolve any dispute informally. We will try to resolve the dispute within 30 days. If we cannot, either party may proceed to formal dispute resolution.

Binding Arbitration. Except for disputes involving intellectual property infringement or as otherwise required by law, you and Thryvo agree that any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, or remotely, at your option. The arbitrator's decision shall be final and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. YOU AND THRYVO EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. You may not consolidate your claims with those of any other person.

EU/UK Users. If you are located in the European Union or United Kingdom, you may have additional rights under applicable consumer protection laws that cannot be waived by contract, including the right to bring proceedings in the courts of your country of residence. Nothing in these Terms limits your statutory rights.
